TERMS & CONDITIONS — OVIAL WEAR

Last Updated: September 2026

These Terms & Conditions govern use of the OVIAL WEAR website and, where applicable, inquiries, quotations, product development, samples, custom manufacturing, and orders placed with OVIAL WEAR.

By using our website or proceeding with a quotation or manufacturing order, you acknowledge that you have reviewed the terms applicable to the relevant service or transaction.

Custom Manufacturing

OVIAL WEAR specializes in custom apparel manufacturing.

Product appearance, fabric, construction, sizing, printing, embroidery, labels, packaging, quantities, pricing, and production requirements may vary from one project to another.

Clients are responsible for reviewing quotations, samples, mockups, artwork, specifications, size charts, and order information before providing approval.

Quotations

Quotes may be based on product specifications, materials, customization methods, quantities, packaging requirements, and other information available at the time.

A quotation may be revised where specifications, quantities, materials, designs, exchange conditions, shipping requirements, or other relevant factors change before order confirmation.

Unless specifically stated otherwise, a quotation should not be interpreted as a permanent price guarantee.

Samples and Product Development

Samples may be produced before bulk manufacturing where agreed.

Because samples are individually developed, minor differences can occur between digital mockups, sample products, and bulk production due to fabric behavior, manufacturing processes, screen displays, printing methods, dye lots, and other technical factors.

Where a sample is approved, bulk manufacturing will normally follow the approved specifications subject to reasonable production tolerances.

Artwork and Approval

Clients are responsible for checking artwork, spelling, numbers, names, logos, colors, placements, dimensions, and other customization details before final approval.

Once production begins following client approval, changes may not be possible or may involve additional cost and production time.

OVIAL WEAR is not responsible for errors contained in artwork or specifications that were supplied or approved by the client.

Intellectual Property

Clients represent that they have the right to use all logos, trademarks, names, graphics, artwork, designs, and other intellectual property supplied for manufacturing.

OVIAL WEAR should not be held responsible for intellectual-property claims arising from materials supplied or specifically requested by a client without the necessary rights.

OVIAL WEAR branding, website graphics, original website content, and proprietary materials may not be reproduced or commercially used without authorization.

Colors and Materials

Colors viewed on screens can differ from physical materials or printed products because monitors, devices, lighting, fabric composition, printing methods, and production batches can display colors differently.

Reasonable variations in shades, fabric texture, weight, measurements, or other production characteristics may occur in custom manufacturing.

Where exact matching is critical, this requirement should be communicated during product development.

Sizing and Measurements

Clients should review the relevant size charts or approved measurement specifications before confirming production.

Custom-manufactured garments may have reasonable manufacturing tolerances due to fabric behavior, stitching, construction methods, and manual measurement.

Production Time

Production schedules are generally estimated after specifications and required approvals are finalized.

Production may depend on factors including material availability, order quantity, customization complexity, approval speed, factory workload, holidays, unforeseen technical issues, and other circumstances.

Any timeline supplied should be treated according to the specific written quotation or order confirmation.

Shipping and Delivery

Shipping arrangements may depend on destination, shipment size, delivery method, courier or freight provider, customs requirements, and other logistics considerations.

Once goods are handed to an external carrier, delivery timelines may be affected by customs processing, transport disruptions, weather, local regulations, carrier operations, or circumstances outside OVIAL WEAR’s reasonable control.

Clients are responsible for providing complete and accurate delivery information.

Import Duties and Taxes

International orders may be subject to customs duties, import taxes, brokerage charges, or other government fees imposed by the destination country.

Unless specifically included in the agreed quotation, such charges are generally the responsibility of the receiving party.

Payments

Payment requirements, deposit amounts, balances, currencies, payment methods, and payment timing should be confirmed in the applicable quotation, invoice, or order agreement.

Production may not begin until any required advance payment and necessary approvals have been received.

Final dispatch may be subject to completion of any outstanding payment obligations.

Custom Products, Cancellation and Returns

Because customized products are manufactured specifically according to client requirements, confirmed custom orders may not be eligible for cancellation, exchange, or return simply because the customer changes their mind.

If an issue is believed to result from manufacturing, the client should contact OVIAL WEAR promptly and provide relevant details, order information, photographs, or other evidence so the matter can be reviewed.

Any agreed remedy will depend on the circumstances, applicable order terms, and nature of the issue.

Claims for Manufacturing Issues

Clients should inspect received goods within a reasonable period after delivery.

Any reported issue should identify the affected products and clearly explain the concern. Where necessary, OVIAL WEAR may request photographs, measurements, samples, or other information before determining an appropriate response.

Normal production tolerances, insignificant cosmetic variations, or differences previously disclosed or approved may not constitute manufacturing defects.

Website Information

We aim to keep website information useful and accurate; however, product descriptions, visuals, colors, specifications, categories, availability, and other content may be updated over time.

Website images may be illustrative and should not automatically be interpreted as exact specifications for a particular custom order.

The final approved quotation and product specification should govern each manufacturing project.

Limitation of Liability

To the extent permitted by applicable law, OVIAL WEAR’s responsibility for a particular manufacturing issue should be assessed in accordance with the specific transaction, agreed specifications, and applicable legal requirements.

Nothing in these Terms is intended to exclude any right or liability that cannot legally be excluded.

Force Majeure

OVIAL WEAR will not be responsible for delays or failure caused by events reasonably outside its control, which may include natural disasters, transport interruptions, government restrictions, strikes, war, civil disturbance, epidemics, utility failures, supply-chain disruption, or other extraordinary events.

Changes to Terms

These Terms & Conditions may be revised occasionally as OVIAL WEAR’s website, services, or business practices develop.

The latest published version will apply to website use, while individual manufacturing transactions may also be governed by separate quotations, invoices, purchase orders, or written agreements.
